10% Buyer's Premium added to final bid. 10% down at auction end (buyer has 48 hours to bring in a cashiers check or wire funds). Balance due upon closing within 30 days. An easement to the existing spring will be reserved for James Smiddy.
Auction has a 5 minute extend at auction end. Meaning, auction will not close until there has not been a bid for 5 minutes. If a bid is made within 5 minutes of auction end time, it will automatically extend 5 more minutes.
The bid/offer made by the Bidder on auction day shall be binding on the Bidder. The confirmed Bidder (the "Purchaser") shall pay the required Earnest Money Deposit to Ayers Escrow on Auction day or within 48 hours and shall execute and deliver a completed Contract for Sale and Purchase (the "Sales Contract"), together with all related Exhibits for such Property at the Auction. The fully executed Sales Contract (together with all related Exhibits thereto) shall control all terms and conditions of the sale and constitute the entire agreement between Purchaser and Seller. In the event of any conflict between these Terms and Conditions of Sale and Terms and Conditions for such Sales Contract, the Terms and Conditions of the Sales Contract shall prevail. NO CHANGES TO THE TERMS OF THE SALES CONTRACT WILL BE PERMITTED. PURCHASER WILL REQUIRED TO ENTER INTO THE SALES CONTRACT "AS IS" ON AUCTION DAY.
